Terms of Service

Vive is operated by ZDN Enterprises, LLC (DBA Collabinlab). In these terms, "we," "us," and "our" refer to ZDN Enterprises, LLC. These Terms of Service govern your use of the Vive mobile application and the website at vivewith.me.

1. Acceptance of Terms

By creating an account or using Vive, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the app. You must be at least 13 years old to use Vive.

2. Description of Service

Vive provides wellness tools including guided meditations, breathwork exercises, soundscapes, mood tracking, and social features. The app is available for iOS devices. Features may change over time as we improve the service.

3. Account Registration

To use Vive, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials and for all activity under your account. You agree to provide accurate information during registration and to keep it up to date.

4. Subscriptions and Payments

Vive offers optional paid subscriptions. Current pricing is available within the app. Key terms:

  • Subscriptions are billed through Apple's App Store and are subject to Apple's payment terms
  • Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period
  • You can manage or cancel your subscription at any time through your Apple ID settings
  • Refunds are handled by Apple in accordance with their refund policy
  • Free features remain accessible without a subscription and are not conditional on granting access to personal data beyond what is required for account creation

5. User Conduct

You agree not to:

  • Harass, bully, or intimidate other users
  • Post spam, offensive, or inappropriate content
  • Attempt to gain unauthorized access to other accounts or our systems
  • Use the app for any illegal purpose
  • Reverse-engineer, decompile, or disassemble the app
  • Circumvent any security or access controls

We reserve the right to suspend or terminate accounts that violate these terms.

6. User Content

You retain ownership of content you create in Vive (such as mood entries and journal notes). By using social features, you grant us a limited license to display your shared content (such as leaderboard data and friend activity) to other users you have connected with. You may delete your content at any time, and we will remove it in accordance with our Privacy Policy.

7. Privacy and Data

Your use of Vive is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using Vive, you consent to the data practices described in that policy. Key points:

  • We collect only data necessary to provide the service
  • We do not sell your personal information
  • You can delete your account and data at any time from within the app via Settings > Account > Delete Account
  • You can withdraw consent for data collection as described in the Privacy Policy

8. Account Deletion

You may delete your account at any time directly within the app by navigating to Settings > Account > Delete Account. Upon deletion:

  • Your personal data will be permanently deleted within 30 days
  • Any active subscription should be cancelled separately through your Apple ID settings to avoid further charges
  • Anonymized, aggregated data that cannot identify you may be retained

9. Health Disclaimer

Vive is a wellness tool and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition. Do not disregard professional medical advice or delay seeking it because of information provided by Vive.

10. Intellectual Property

All content, features, and functionality of Vive (including but not limited to meditations, soundscapes, designs, text, graphics, and software) are owned by ZDN Enterprises, LLC and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

11. Limitation of Liability

To the maximum extent permitted by law, ZDN Enterprises, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Vive. Our total liability for any claim arising from these terms shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Termination

We may suspend or terminate your access to Vive at any time for violation of these terms, with or without notice. You may stop using Vive and delete your account at any time. Sections that by their nature should survive termination (including liability limitations, intellectual property, and disclaimers) will remain in effect.

13. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes through the app or by email. Continued use of Vive after changes take effect constitutes acceptance of the updated terms. If you do not agree with the changes, you should stop using the app and delete your account.

14. Governing Law

These terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved in the courts located in the State of California.
